Please read these Terms and Conditions (“Terms”, “Agreement”) carefully before using MyBusinessBook. By creating an account, installing the App, or using any part of the Service, you confirm that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use the App or website.
A note on compliance: We have made every effort to ensure these Terms are accurate, complete, and compliant with applicable law. If you believe there is an error in these Terms, or that the App or its practices may not comply with a legal requirement applicable to your use, please contact us immediately at help@mybusinessbook.app or +91 87920 40344. We take compliance seriously and will investigate all concerns and take corrective steps without delay.
1. Who We Are
MyBusinessBook (“we”, “us”, “our”) operates a digital record-keeping application (“the App”) accessible via Android (Google Play), iOS (Apple App Store), and the website mybusinessbook.com (collectively, “the Service”).
What the Service is: A tool for lenders and small business owners to maintain their own loan books — recording borrower details, loans, payments, and generating receipts.
What the Service is not:
- We are not a bank, non-banking financial company (NBFC), payment aggregator, financial institution, microfinance institution, or credit bureau.
- We do not provide, arrange, broker, facilitate, underwrite, guarantee, or endorse any loan or financial product.
- We do not offer financial advice, legal advice, tax advice, or accounting services.
- Any lending activity carried out using records kept in the App is entirely your own business activity, subject to your own legal and regulatory obligations.
2. Eligibility
You may use the Service only if all of the following conditions are met:
- You are at least 18 years of age.
- You have the legal capacity to enter into a binding contract under the laws of your jurisdiction (including India’s Indian Contract Act, 1872).
- You are legally permitted to operate a lending or money-lending business in your jurisdiction, or you are using the App solely for record-keeping in a lawful personal or professional capacity.
- You are not prohibited from using the Service by any applicable law, regulation, court order, or sanction.
- You have not previously been suspended or terminated from the Service for breach of these Terms.
By creating an account, you represent and warrant that you satisfy all of the above conditions. If you are using the App on behalf of a business entity, you also represent that you have the authority to bind that entity to these Terms.
3. Account Registration and Security
3.1 Account Creation
- You must register using a valid mobile phone number in your name. Account access is verified by a one-time password (OTP) sent to that number.
- You must provide accurate, current, and complete information during registration and keep it updated.
- Each phone number may be associated with one account only.
3.2 Account Security
- You are solely responsible for maintaining the confidentiality of your account access and for all activity that occurs under your account.
- You must not share your account with any other person or permit any other person to access the App using your credentials.
- You must notify us immediately if you suspect unauthorised access to your account: help@mybusinessbook.app or +91 87920 40344.
- We are not liable for any loss or damage arising from your failure to maintain account security.
3.3 Account Suspension by Us
We reserve the right to suspend, restrict, or terminate your account without prior notice if we have reasonable grounds to believe that:
- Your account has been compromised.
- Your account is being used for fraud, money laundering, or any illegal activity.
- You have materially breached these Terms.
- Continued operation of your account creates a legal, security, or reputational risk to us or to other users.
4. Lender Responsibilities and Legal Compliance
4.1 Your Lending Activity Is Your Responsibility
You acknowledge and agree that:
- You are solely responsible for the legality of your lending activity and
for complying with all applicable laws, rules, and regulations, including
(without limitation):
- The applicable state money-lending Act in the state(s) where you operate (e.g., the Karnataka Money-Lenders Act, the Maharashtra Money-Lending (Regulation) Act, etc.). These laws typically require registration as a money-lender and limit permissible interest rates.
- Reserve Bank of India (RBI) directions applicable to your type of lending activity, if any.
- The Prevention of Money Laundering Act 2002 (PMLA) and applicable Know Your Customer (KYC) norms.
- Any applicable income tax and GST obligations on interest income and service income.
- MyBusinessBook does not advise you on whether your lending is lawful. You should consult a qualified legal or financial adviser.
- We are not responsible for any regulatory action, fine, prosecution, or civil liability arising from your lending activity or your use of the App.
4.2 Responsibilities as a Data Fiduciary
Under India’s Digital Personal Data Protection Act 2023 (DPDP Act), you are the Data Fiduciary for the borrower (customer) personal data you enter into the App. This means you are legally responsible for:
- Collecting borrower data lawfully and with a valid legal basis and, where required, the data principal’s free, specific, and informed consent.
- Informing borrowers of their rights under the DPDP Act and providing a notice of how their data is being processed.
- Ensuring the accuracy and completeness of the records you maintain.
- Using borrower data only for legitimate lending and record-keeping purposes.
- Responding to borrowers’ requests to access, correct, or erase their data.
- Not entering data about a person that you did not collect through lawful means or that the person did not voluntarily provide to you.
5. Acceptable Use
5.1 Permitted Uses
You may use the App to:
- Record your own lending transactions, borrower details, and payments.
- Generate and share receipts with your own borrowers.
- Manage your own business records relating to your lending activity.
5.2 Prohibited Uses
You must not use the Service to:
- Violate any applicable law, rule, or regulation, including lending laws, KYC norms, anti-money-laundering rules, or privacy law.
- Engage in or facilitate fraud, identity theft, money laundering, terrorist financing, or any criminal activity.
- Record transactions for a third party’s lending business without that party’s written authorisation and without accepting responsibility as their data processor.
- Enter false, fabricated, or misleading data about borrowers or loan terms.
- Circumvent, disable, or interfere with any security feature or access control of the App.
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
- Use automated bots, scripts, scrapers, or crawlers against the App or API.
- Probe, scan, or test the vulnerability of our systems or networks without our prior written authorisation.
- Harvest or collect data about other users.
- Impersonate any person or entity or misrepresent your affiliation.
- Transmit malware, viruses, or any code designed to harm or interfere with systems.
- Attempt to gain unauthorised access to another account’s data.
- Use the Service in any way that could damage, disable, or impair it or interfere with any other party’s use.
- Sublicense, resell, or commercialise the Service without our prior written agreement.
Violation of Section 5.2 may result in immediate account termination and, where applicable, referral to law enforcement.
6. Intellectual Property
6.1 Our Property
The App, website, design, trademarks, brand name, logo, and all content created by us (including but not limited to software, user interface, documentation, and marketing materials) are our intellectual property or are licensed to us, and are protected by applicable law including the Copyright Act, 1957, the Trade Marks Act, 1999, and international IP treaties.
6.2 Licence to You
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, solely for your own legitimate record-keeping purposes and in accordance with these Terms. This licence does not include the right to sublicense, resell, copy, modify, or create derivative works.
6.3 Your Data
You retain ownership of all data you enter into the App (your loan records, borrower information, etc.). By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, process, replicate, and display that data solely to provide the Service to you. This licence ends when the data is permanently deleted under Section 10.
6.4 Feedback
If you provide us with suggestions, feedback, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation.
7. Privacy and Data
Our practices for collecting, using, storing, sharing, and deleting personal data are described in our Privacy Policy, which forms part of these Terms. By using the Service, you also agree to the Privacy Policy.
8. Third-Party Services
The App is built on and delivered via third-party infrastructure. Your use of the App means your data passes through these services, each governed by their own terms:

We are not responsible for the acts or omissions of these third-party providers. Their terms govern your relationship with them. We recommend you review these independently.
9. Fees, Subscriptions, and Payments
Where we offer a paid subscription or paid feature:
- Fees will be clearly disclosed before any purchase.
- Payments are processed by the platform’s native in-app purchase system (Apple App Store or Google Play). We do not directly handle your payment card information.
- Subscriptions are billed in advance for the selected billing period.
- Cancellation stops future billing but does not entitle you to a refund for the current billing period, except where required by applicable law or the platform’s refund policy.
- We reserve the right to change pricing with reasonable prior notice. Existing subscribers will be notified before any price change takes effect on their subscription.
10. Account Deletion and Data Removal
You may stop using the Service and request deletion of your account and all associated data at any time via the Delete Account & Data page. Data deletion follows the process described in detail in our Privacy Policy (Section 7). Once permanently deleted, data cannot be recovered.
11. Service Availability and Modifications
- We aim to keep the Service available but do not guarantee uninterrupted, error-free, or always-on availability. The Service may be unavailable during maintenance, infrastructure outages, or events outside our control.
- We may add, modify, or remove features, functionality, or content at any time. For changes that materially reduce existing functionality, we will provide reasonable advance notice.
- We may discontinue the Service on reasonable notice. If we discontinue the Service, we will provide a way for you to export your data before the Service closes.
12. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available” without any representation or warranty of any kind, express, implied, statutory, or otherwise, including (without limitation) any warranty of:
- Merchantability or fitness for a particular purpose;
- Accuracy, completeness, or currency of financial calculations, records, or outputs;
- Uninterrupted or error-free operation;
- Security (beyond our stated measures) or freedom from viruses or harmful code;
- Regulatory compliance of any output for your specific business or jurisdiction.
You are solely and exclusively responsible for verifying all your own financial records, calculations, and legal obligations. The App is a record- keeping tool, not a source of legal, financial, tax, accounting, or compliance advice.
13. Limitation of Liability
To the maximum extent permitted by applicable law:

We are not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for any loss of profits, revenue, business, data, goodwill, or business opportunity, arising from or in connection with your use of or inability to use the Service — even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising from these Terms or your use of the Service (whether in contract, tort, statute, or otherwise) shall not exceed the greater of (a) the total amount you paid us in the 12 months immediately preceding the event giving rise to the claim, or (b) ₹1,000 (Indian Rupees One Thousand).

These limitations apply regardless of the form of action and regardless of whether any limited remedy fails of its essential purpose.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by our negligence, or liability arising from fraud or fraudulent misrepresentation.
14. Indemnification
You agree to indemnify, defend, and hold harmless MyBusinessBook and its owners, directors, officers, employees, agents, and service providers from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising from or relating to:
- Your use of or access to the Service;
- Your lending activity or any borrower relationship;
- Your breach of these Terms or any applicable law or regulation;
- Your violation of any third-party rights, including privacy, intellectual property, or data protection rights;
- Any data you entered into the App, including any claim by a borrower;
- Your failure to comply with applicable money-lending, KYC, or data-protection laws as a Data Fiduciary.
15. Force Majeure
We are not liable for any failure or delay in performance of our obligations caused by circumstances beyond our reasonable control, including (without limitation): natural disasters, acts of God, war, terrorism, pandemic, government action, power failures, internet outages, third-party infrastructure failure (including Google Firebase outages), or strikes. In such circumstances, our obligations are suspended for the duration of the event.
16. Suspension and Termination
16.1 Termination by You
You may stop using the Service and delete your account at any time via the Delete Account & Data page. Termination does not affect any accrued rights or obligations.
16.2 Termination or Suspension by Us
We may suspend your access with prior notice if you breach these Terms.
We may suspend or terminate your access immediately and without notice in cases of:
- Fraud, criminal activity, or money laundering;
- A material security threat to us or other users;
- A legal order requiring us to do so;
- Conduct that causes or risks causing significant harm.
16.3 Effect of Termination
On termination, your licence to use the App ends immediately. Data deletion follows the process in the Privacy Policy. Sections 6.1, 12, 13, 14, 17, and 18 survive termination.
17. Governing Law and Dispute Resolution
These Terms are governed by and shall be construed in accordance with the laws of India, without regard to conflict-of-law principles.
Step 1 — Informal resolution: If you have a dispute, please first contact us at help@mybusinessbook.app or +91 87920 40344. We will make a genuine effort to resolve it informally within 30 days of receiving your written notice.
Step 2 — Jurisdiction: If informal resolution fails, any dispute, claim, or controversy arising from or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.
Nothing in this section prevents either party from seeking emergency injunctive or equitable relief from a court of competent jurisdiction to protect intellectual property rights or confidential information.
18. General Provisions
18.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and MyBusinessBook regarding the Service and supersede all prior or contemporaneous representations, understandings, and agreements.
18.2 Severability
If any provision of these Terms is found by a court to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions remain in full force and effect.
18.3 No Waiver
Our failure to enforce any right or provision of these Terms on any occasion shall not constitute a waiver of that right or provision on any other occasion.
18.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations, including in connection with a merger, acquisition, or sale of assets, on notice to you.
18.5 No Partnership or Agency
Nothing in these Terms creates a partnership, joint venture, employment relationship, or agency between you and us. You have no authority to bind us in any way.
18.6 Notices
Notices from us to you may be sent via the App, to the phone number registered to your account, or posted on the website. Notices from you to us must be sent to help@mybusinessbook.app.
19. Changes to These Terms
We may update these Terms. When we make material changes, we will:
- Update the “Effective” date at the top of this page.
- Notify you through the App or by other reasonable means at least 14 days before the changes take effect (or immediately, if required by law).
If you disagree with the updated Terms, you may stop using the Service and delete your account before the effective date. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
